1st. The PURPOSE of this contract is to provide SWIMMING CLASSES services, taking into account the physical conditions and motor skills of the STUDENT.
2nd. If you have a disease that imposes limitations on physical activity, the STUDENT must deliver to NAKAMURA SWIMMING LLC a medical report informing such a condition. Failure to do so will be assumed to be in perfect physical condition, and NAKAMURA SWIMMING LLC cannot, under any circumstances, be held responsible, directly or indirectly, legally or administratively, for any possible health problems that the STUDENT may have. have due to pre-existing illness.
3rd. NAKAMURA SWIMMING LLC will provide the services at the chosen and previously established times. The student's tardiness will not be tolerated and, if it occurs, it will be deducted from the total of the class.
4th. In this service, there will only be replacement of classes in case of absences, due to illness where the STUDENT must prove by means of a medical certificate within 24 hours after the absence of the illness that was the reason for his/her absence.
5th. If NAKAMURA SWIMMING LLC needs to reschedule the classes due to force majeure or health reasons, it must inform the STUDENT at least 12 hours in advance and it will replace the class according to a vacancy in the SWIMMING NAKAMURA agenda.
6th. The STUDENT who requests that the services provided by at their residence or at a different location established by NAKAMURA SWIMMING LLC must provide means for the classes to take place in accordance with the requirements of NAKAMURA SWIMMING LLC.
7th. For the provision of the contracted services, the STUDENT will pay NAKAMURA SWIMMING LLC the amount sent by the invoice due on the day of registration and, thereafter, every 30 days.
Paragraph One – We do accept credit/debit card. Plans are due in advance.
Paragraph Two - NAKAMURA SWIMMING LLC will make an annual readjustment, agreed by both parties notifying at least 01 (one) month in advance.
8th. There will also be NO REFUND of amounts paid, unless for reasons of health duly proven by means of a medical certificate and report.
First Paragraph - In case the STUDENT is absent from classes due to travel/vacation and wishes to keep his/her place in the SWIMMING NAKAMURA LLC agenda, the STUDENT must notify at least 30 (thirty) days and must pay a scheduled maintenance fee of 50% of the amount that would be paid for the period in question.
9th. In the event that the STUDENT cancels the lesson, they must be aware of the CANCELLATION POLICIES, adhering to the following conditions:

Cancellation with 24 hours' notice - No fee, available for make up (see make-up rules)
10th. Make-up classes:
Must be made up within the month in which the class was missed.
On a 4-class plan, only 1 class can be made up.
On a 12-class plan, up to 3 classes can be made up.
On a 24-class plan, up to 6 classes can be made up.
11th. If you need to PAUSE your plan:
12-class package, up to 15 days
24-class package, up to 30 days
12th. If you need to cancel your plan before the end of your contract, a 20% penalty will apply to the remaining payment.
13th. This contract shall be terminated automatically in the event of non-compliance with any of its clauses by the parties.
Digital Signatures
The parties agree that this document may be executed and accepted by electronic or digital signature, which shall be considered valid, binding, and legally enforceable. Pursuant to the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN Act, 2000) and the Uniform Electronic Transactions Act (UETA), an electronic signature has the same legal effect as a handwritten signature. By signing electronically, each party consents to conduct business using electronic records and signatures.
